Resign the wrong way in probation and you could face a one-year work permit ban. Skip the notice and you could owe your employer up to a month of wages. Many new hires learn this only after the letter is sent.
The UAE probation period lasts six months at most under Federal Decree-Law No. 33 of 2021. Your notice depends on who ends the contract. It also depends on whether you are joining another UAE employer or leaving the country.
This guide gives you the exact rules from Article 9. You will see the notice table and the work permit ban with its exemptions. You will also see the recruitment cost rule and how pay, leave and gratuity work.
It covers mainland private-sector employment. Government roles, domestic workers, DIFC and ADGM follow separate rules. Check your own figures with the UAE gratuity calculator once you pass one year.
What is the probation period in the UAE?
The probation period in the UAE is a trial of up to six months at the start of a job. During it, either side can end the contract on short statutory notice.
Article 9 of Federal Decree-Law No. 33 of 2021 sets the limits. Your signed contract states your exact probation length. Check it before you plan any move.
NOTE: You are a full employee during probation. Your employer must pay your agreed wage on time.
How long can probation last, and when does it start?
The probation period cannot exceed six months, counted from the date you start work. It does not run from your offer date or visa date.
| Contract wording | What it means |
|---|---|
| Three-month probation | Your trial lasts three months. It does not roll into a second period. |
| Six-month probation | This is the legal maximum under Article 9. |
Article 67 counts a month as 30 days. So six months means 180 days, not six calendar months. Start on 1 March 2026 and count that day as day 1. Day 180 then falls on 27 August 2026, not 1 September.
TIP: Ask HR to confirm your probation end date in writing. Keep your own record of your first working day.
Can an employer extend or repeat probation?
Probation cannot exceed six months, and the same employer cannot place you on probation more than once.
Article 9(2) says a worker may not be placed on probation more than once with one employer. If you pass and keep working, the contract continues on its agreed terms. The probation period then counts as service.
If your employer proposes extending a shorter probation, ask MOHRE whether the amendment is permitted before you sign. For the wider picture, read our UAE Labour Law 2026 guide.
What notice applies during probation?
Your notice depends on who ends the contract. If you resign, it also depends on whether you stay in the UAE or leave.
| Situation | Who gives notice | Written notice required | Legal basis |
|---|---|---|---|
| Employer ends your contract | Employer | At least 14 days | Article 9(1) |
| You resign to join another UAE employer | You | At least one month | Article 9(3) |
| You resign to leave the UAE | You | At least 14 days | Article 9(4) |
WARNING: Notice must be in writing. Keep proof that your employer received it.
After probation, your contract notice of 30 to 90 days applies instead. Use the UAE notice period calculator to confirm your last working day.
What happens if notice is cut short?
The party that breaks the notice rule pays the other party the worker’s wage for the missing notice period. Article 9(5) sets this rule for both employers and workers.
Take a worker on AED 9,000 a month who joins another UAE employer. The law requires one month, so 30 days. The worker leaves after 14 days and is 16 days short.
| Step | Working | Result |
|---|---|---|
| Daily wage | AED 9,000 ÷ 30 | AED 300 |
| Missing notice days | 30 − 14 | 16 days |
| Compensation owed | 16 × AED 300 | AED 4,800 |
The law says “wage”, so check whether your contract wage includes allowances. This claim is separate from the work permit ban covered below.
What happens if your employer ends your contract during probation?
Your employer can end your contract during probation if it gives you at least 14 days of written notice. Article 9(1) allows this.
You keep your wage up to your last day. If you have not passed probation, Article 29(3) also entitles you to pay for your remaining annual leave balance. Ask HR for the exact figure and check it with our leave salary calculator.
You do not receive end-of-service gratuity. Article 51 requires at least one year of continuous service, and probation lasts six months at most. If your employer skips the 14 days, it owes you your wage for the missing days. Your employer must also pay all dues within 14 days of the contract end date under Article 53.
How do you resign during probation the right way?
Give written notice that matches your next step, then keep working until your last day. You owe 14 days if leaving the UAE, or one month if joining another UAE employer.
You can resign at any point in your probation. Put your last working day in writing and keep proof of delivery. Our resignation letter templates include a probation version. Compare the two exits in our termination vs resignation guide.

What should you check before you resign during probation?
- Confirm your first working day and the probation end date in your contract
- Decide whether you are joining a UAE employer or leaving the country
- Write the resignation with your last working day
- Keep proof that your employer received it
- Ask for an itemised final settlement before your last day
- Check ban exemptions with MOHRE if you plan to leave early
Can leaving incorrectly trigger a one-year work permit ban?
Yes, leaving the UAE without following Article 9 means no new work permit for one year from departure. Article 9(6) sets this ban.
WARNING: A new job offer does not remove the ban. Settle the notice question before you travel.
The Ministry may exempt some workers from the ban. Cabinet Resolution No. 1 of 2022, Article 11, lists who it may exempt.
| Who the Ministry may exempt |
|---|
| Workers with skills, professional or knowledge levels the State needs |
| Workers sponsored by their parents |
| Golden residency holders |
| Professional categories set by a ministerial resolution under the approved manpower classification |
IMPORTANT: The Ministry decides exemptions case by case. Do not assume you qualify. Confirm with MOHRE before you leave.
Who pays recruitment costs when you change jobs?
Your new employer pays your original employer’s recruitment or contracting costs, unless they agree otherwise. Article 9(3) sets this rule.
Article 6(4) prohibits employers from charging workers recruitment and employment costs, directly or indirectly. If your employer demands payment, ask MOHRE to review the charge before paying or accepting a deduction.
A similar rule applies if you leave the UAE and return within three months on a new work permit. The new employer pays, unless you and the original employer agree otherwise. This is separate from any notice compensation you owe.
What salary, leave and gratuity rights apply during probation?
You get your full agreed wage during probation. Leave, sick leave and gratuity each follow their own rules.
| Right | Position during probation | Basis |
|---|---|---|
| Salary | Your agreed wage stays payable in full | Employment contract |
| Annual leave | Your employer decides whether to grant leave. If you leave before passing probation, you are paid for your remaining leave balance | Article 29(3) |
| Sick leave | No paid sick leave. Your employer may grant unpaid sick leave on a medical report | Article 31(2) |
| End-of-service gratuity | Not payable. It needs at least one year of continuous service | Article 51(2) |
Gratuity uses your last basic wage. Learn how we calculate it on our calculator methodology page.
Does probation count toward your service period?
Yes, if you pass probation and keep working. Article 9(2) counts the probation period within your service period.
That matters for gratuity once you pass one year. Include your probation months when you run the UAE gratuity calculator. If you exit during probation, you never reach the one-year threshold. Your wage and leave pay for time worked stay owed.
More gratuity answers are in our UAE gratuity FAQ.
What happens when probation ends?
Your contract continues on its agreed terms, and the standard notice period in your contract replaces the short probation notice. Article 43 allows 30 to 90 days, as your contract states.
Ask HR to confirm your completion date in writing. Check which contract type you hold in our limited vs unlimited contract guide.
Which probation mistakes cost the most?
Most probation disputes start with one of five errors. Each has a cheap fix if you catch it before you act.
| Mistake | Why it costs you | The fix |
|---|---|---|
| Assuming no notice is owed in probation | Article 9 requires 14 days or one month in writing | Match your exit to the notice table |
| Counting six calendar months | Article 67 counts a month as 30 days | Count 30-day months from your first working day |
| Leaving the UAE without notice | It can trigger the one-year work permit ban | Give written notice or confirm an exemption |
| Accepting a hiring-cost charge without checking | Article 6(4) bars employers from charging you recruitment costs | Ask MOHRE to review the charge before you pay anything |
| Expecting gratuity after a probation exit | Article 51 needs one full year of service | Check your total service, not the probation length |
Six months feels long until you are two weeks in and need to move fast. Confirm your start date, your contract’s probation length, and which exit scenario applies. Then give written notice. Once your timeline is clear, calculate your end-of-service entitlement for the years ahead.
