UAE end-of-service gratuity is a legal payment your employer makes when your job ends. The amount is based on your last basic salary under Article 51 of Federal Decree-Law No. 33 of 2021. These six questions cover what it is, who gets it, and how it works.
What is gratuity in the UAE?
Gratuity is a lump sum your employer pays when your job ends, whether by resignation or termination. It is calculated on your last basic salary only. Does probation count toward my one-year gratuity eligibility?
Yes. Your probation period counts as continuous service if you stay on after it ends. There is no separate one-year clock that restarts once probation is confirmed. Is UAE gratuity calculated on basic salary or full salary?
Gratuity is calculated on your last basic salary only. Article 51 bases gratuity on basic wage. The Article 1 definition excludes allowances from basic wage. How much gratuity do I get for a partial year of service?
Your final partial year is pro-rated by the number of months actually worked. If you complete 6 months into a new year, you receive half that year’s applicable rate. This applies whether you are in your first five years or beyond. Source: Article 51 of Federal Decree-Law No. 33 of 2021.
Do I get gratuity if my fixed-term contract ends and is not renewed?

Does gratuity apply to part-time employees in the UAE?
Yes. Part-time employees are entitled to gratuity under Cabinet Resolution No. 1 of 2022, the Executive Regulations of Federal Decree-Law No. 33 of 2021. The amount is calculated proportionally based on hours worked compared to a full-time equivalent. The one-year minimum still applies. Does gratuity accrue during a probation notice period?
Yes, if you were confirmed after probation and later resign or are terminated, your probation notice days still count as service. Can my gratuity be reduced below what my service years entitle me to?
No, once your service years are set, the 21-day and 30-day formula applies without discretionary reduction. Lawful deductions can still reduce your final payout amount, including documented loans or salary overpayments. This is permitted under Article 51(7) of Federal Decree-Law No. 33 of 2021 and Article 29(1)(a) of its Executive Regulations.
Does resignation before five years reduce my gratuity?
Under the current law, no. Article 51 of Federal Decree-Law No. 33 of 2021 removed the old reduction system. If you resign after one year, you receive full gratuity. Does renewing my contract reset my gratuity in the UAE?
No. Renewing with the same employer does not reset your gratuity. Service is continuous across renewals. Your total years keep accumulating toward the 21-day and 30-day tiers. Final Settlement Questions
Your final settlement includes gratuity, unused leave pay, unpaid wages, and other agreed amounts. These questions cover timing, deductions, and what to do when payment falls short.
What is not included in UAE final settlement?
Discretionary bonuses, unvested commission, and unused sick leave are not part of your final settlement. These depend on company policy, not statutory entitlement. Other statutory or contractual amounts may also be due, depending on your case. Confirm bonus and commission terms directly with HR.
When must an employer pay final settlement in the UAE?
Your employer must pay within 14 days of your last working day under Article 53 of Federal Decree-Law No. 33 of 2021. The clock starts from your actual last day, not visa cancellation. Can my employer deduct a loan from my final settlement?
Your employer may deduct certain legally payable amounts from your final settlement, including documented loans or salary overpayments. This is permitted under Article 51(7) of Federal Decree-Law No. 33 of 2021 and Article 29(1)(a) of its Executive Regulations. Request an itemized statement and supporting records for every deduction. Raise the matter with MOHRE if it is not resolved.
Should I sign my final settlement before receiving payment?
Do not sign a full and final receipt unless payment has actually been received and checked. Is the deadline different for a gratuity claim versus a salary claim?
No, both fall under the same two-year window under Article 54(9) of Federal Decree-Law No. 33 of 2021. The clock starts from the date your employment relationship ends for both claim types. File promptly regardless of which entitlement is disputed.
Can I dispute my final settlement if I think it is short?
Yes. Put your dispute in writing to HR first and attach your own calculation. If HR does not correct it, file a complaint with MOHRE within the two-year deadline. Leave Salary Questions

Do I lose my unused leave if I am terminated for misconduct?
Unused leave encashment is generally still owed even in a misconduct termination, since it is a separate entitlement from gratuity. An Article 44 dismissal does not itself cancel gratuity under Article 51, although lawful deductions may still apply. Confirm your specific circumstances with MOHRE if disputed. Is unused leave encashment calculated on basic salary or full wage?
Unused leave encashment at termination is commonly calculated on basic wage under the executive regulations. This uses the same wage base as your gratuity calculation. Does taking sick leave beyond my paid entitlement affect my gratuity?
Only the unpaid portion does. Sick leave runs in three tiers under Article 31(3)(a) to (c) of Federal Decree-Law No. 33 of 2021. These are full pay, then half pay, then unpaid once you exceed both. Only unpaid sick leave days are excluded from your gratuity service period, under Article 51(4). Confirm your tier with HR before extended leave.
Can my employer force me to take annual leave before my last working day?
Not simply at will. Article 29 allows the employer to set annual leave according to work requirements in agreement with the worker, or through a rotation arrangement. The employer must give at least one month’s notice. Leave taken before employment ends reduces the unused balance available for encashment.

Does my contract type affect how my final settlement is calculated?
Employment under an indefinite-term contract from before 2 February 2022 may raise transitional issues. Article 65(6) sets specific notice requirements for these older contracts. Am I entitled to a service certificate when I leave my UAE job?
Yes. Your employer must provide a service certificate on request. It confirms your employment dates, job title, and last salary. Request it in writing before your last working day. Refusal is grounds for a MOHRE complaint. Source: Article 13 of Federal Decree-Law No. 33 of 2021.
How do I claim unpaid gratuity in the UAE?
Send a written request to HR first using a formal gratuity application letter. If your final dues remain unpaid after the 14-day period in Article 53, measured from the end date of the contract term, file at mohre.gov.ae or call 600 590 000. MOHRE will attempt amicable settlement. For claims up to AED 50,000, MOHRE can issue a final binding decision without court referral. Larger unresolved claims are referred to the Labour Court.
What happens to my final settlement if I have already left the UAE?
