Can an Employer Deduct From Your Gratuity in the UAE?

Rashid spent nine years as a logistics coordinator in Jebel Ali. His final settlement arrived at AED 14,200 lighter than his own calculation. The line simply read “company adjustment.” Nobody at HR could name the rule behind it. That single line is where most gratuity disputes start.

Check your own figure before you sign anything. You will know which deductions have a legal category behind them. You will know which ones do not. And you will know what proof to demand.

Can an employer deduct from your gratuity in the UAE?

Your gratuity is a statutory entitlement, not a discretionary bonus. That is why the law restricts what can come out of it. The categories below come from Article 29 of Cabinet Resolution No. 1 of 2022.

CategoryWhat it coversWhat your employer should hold
Loan or overpaymentMoney advanced to you, or salary paid in errorSigned loan agreement or a dated payroll record
Pension or insurance shortfallYour own unpaid contribution to a schemeScheme statement showing the specific gap
Disciplinary penaltyA financial penalty applied under company rulesApproved internal regulations and a written penalty notice
Court ordered debtA debt the courts have ordered you to payThe execution order or court judgment
Damage you causedProven loss to company property or fundsEvidence linking the loss to your act or negligence

Which law governs a deduction from gratuity?

What must your employer prove before deducting from gratuity?

Worked Example: Documented deduction

Worked Example: Undocumented deduction

CaseReason givenDocument producedArticle 29 categoryOutcome
Priya, DeiraAED 9,000 salary advanceSigned advance form, datedLoan or overpaymentLawful
Marco, Abu DhabiAED 6,500 equipment and uniformNoneNo matching categoryUnlawful

The difference between the two is paperwork, not fairness. Marco’s employer may genuinely have spent that money. It still does not become his debt at the exit.

Three questions to ask about any deduction line

QuestionWhy it matters
Which category does this fall under?Forces the employer to name a legal basis, not a business reason
What document supports it?A lawful deduction always has paperwork behind it
When was that document signed?Anything signed during your exit is worth examining closely

Your Wage Protection System records are independent evidence. WPS shows what your employer actually transferred each month, not what a settlement letter claims. Check the basic salary in your WPS history against the figure used in your gratuity calculation.

The third question catches more problems than people expect. A loan agreement signed on your last day, alongside your resignation, is worth a closer look before you accept it.

Which deductions from gratuity are unlawful?

Five lawful gratuity deduction categories under Article 29 set against three unlawful ones
DeductionWhy it fails
Recruitment or agency feesA hiring cost carried by the employer, not an employee debt
Visa, permit or medical costsPart of employing you legally, not recoverable at exit
Uniform, tools or equipmentNo category in Article 29 covers general kit
Unexplained amountsA deduction with no named category and no document
General business lossesTrading losses are not a debt you owe personally

Is Your Gratuity Deduction Legal?

Check a deduction from your UAE final settlement against Article 29 in a few seconds.

Pick a reason from the list before checking.
This tool gives a general indication only and is not legal advice. Deduction rules can depend on your specific contract terms and jurisdiction. For a full calculation, use our gratuity calculator.

If your reason is not listed, that is itself a signal. The six options cover the categories that appear in real settlements.

Is there a cap on how much can be deducted from gratuity?

This matters because percentage figures circulate widely online. A 50 percent cap is often quoted. That figure comes from the monthly wage context, not from the gratuity provisions. Do not assume it protects your settlement.

Article 29(2) of Cabinet Resolution No. 1 of 2022 sets a three-month limit specifically for deductions tied to worker violations or damage the worker caused. The clock starts from the date the amount became due, unless the contract says otherwise. This limit does not cover other deduction categories, such as loan recovery or court debts. The practical protection is the category test, not a percentage.

A deduction with no lawful category is challengeable at any size. A deduction with a valid category and full documentation is defensible at any size too.

Can a bank or a court claim your gratuity?

What a lawful court claim looks like

A genuine execution order names the court, the case number and the exact sum. It is addressed to whoever holds the money. Ask which court issued it. Ask what case number it carries. Ask what amount it names. A real order answers all three in a line.

There is also a limit on what any order covers. A court order attaches a specific sum, not your whole entitlement. Anything taken beyond that sum is a separate deduction. It needs its own category under Article 29 to stand.

What an unlawful bank claim looks like

The unlawful version is easy to recognise. A bank calls HR. HR freezes the payment. No order is ever produced. Ask to see the order in writing.

Some employers treat a bank instruction as a court order. They are not the same document. A bank letter is a commercial request. An execution order carries the force of a judgment. Only the second one authorises your employer to release your money.

Employers sometimes freeze a settlement while a bank case is still running. A pending case is not an order. Until a court issues one, your payment deadline keeps running against your employer.

Loans taken through your employer work differently again. A staff loan with a signed agreement is a documented debt. That sits in the first Article 29 category and needs no court involvement at all.

Is it a deduction, or is your whole settlement being withheld?

Mainland and JAFZA employers must settle within 14 days of the employment ending. In ADGM the window is 21 days. Missing that window is a payment breach. It is separate from any argument about deduction categories.

Reasons that do not stop the clock

The sign-to-release trade

The pressure version is more common than a flat refusal. HR offers to release the money once you sign the statement as final. That trade is worth pausing on. Signing does not end your right to claim, but it does weaken your record.

Note the date you were promised and the date you were actually paid. That single pair of dates decides most late-payment complaints.

Where the real dispute is about why your employment ended, that is different again. Take that route separately rather than folding it into a deduction argument.

How to challenge an unlawful deduction from gratuity

Work through it in this order.

  • Step 1: Ask by email for an itemised settlement breakdown.

  • Step 2: Ask which Article 29 category each deduction falls under.

  • Step 3: Ask for the document supporting each deduction.

  • Step 4: Calculate your own figure and note the exact difference in AED.

  • Step 5: If no response is received, escalate the matter to the relevant authority for your jurisdiction.

Step five depends on where you worked. Mainland staff go to MOHRE. JAFZA staff go to JAFZA. TECOM staff go to DDA Workforce Affairs. DIFC and ADGM each route through their own regime.

You have two years to bring a labour claim. Article 54(9) sits in Federal Decree-Law No. 33 of 2021, as amended by Federal Decree-Law No. 9 of 2024. The amendment took effect on 31 August 2024. The clock runs from the date your employment ended. It does not run from the day you signed the settlement or noticed the shortfall.

Frequently Asked Questions

Article 29 does not set one universal consent rule across all five categories. A court judgment or an approved penalty match works differently from a loan agreement, which usually needs your signature. What matters most is whether the deduction genuinely falls inside one of the five permitted categories.

The excess has no basis. Article 29 permits a deduction tied to a documented sum, not a rounded or estimated figure. If your loan agreement shows AED 6,000 and the deduction reads AED 8,000, question the AED 2,000 difference separately. Ask what category and document cover that portion.

Only if it appears on the establishment’s MOHRE-approved penalty list and follows the required internal procedure. Timing alone does not disqualify it. But a penalty first raised at settlement, with no earlier written notice or matching entry on that list, is worth challenging directly with HR.

Your gratuity can be reduced to nil under Article 29’s deduction categories, but your employer cannot claim beyond it from your other settlement components without a separate legal basis. Leave encashment and unpaid salary are distinct entitlements. Ask for each component itemised before accepting a zero gratuity figure.

Get the number right before you sign

Run your own gratuity figure first. Then treat every deduction line as a question, not a fact. Ask which category it falls under and which document supports it. A lawful deduction survives that question easily. An unlawful one usually disappears once you ask in writing. Keep every email, and act well inside the two year window.
